Terms of Service

These Terms govern your use of SmallBusinessDigitalToolkit.com and services offered by Small Business Digital Toolkit LLC (“SBDT”). By using the site or purchasing a service, you agree to these Terms.

Our services

SBDT provides a growing business-resource platform. Services may include website design, hosting and management; domain resources; QR-code creation and analytics; flyer design and distribution; business formation and filing assistance; optional EIN assistance; trademark search or preparation resources; business-credit and D-U-N-S resources; funding and grant discovery; digital downloads; marketing and customer-engagement tools; AI-assisted tools; AI Video Studio and AI Presenter/Clone features; and other products, dashboards, integrations or services displayed on the site. Features may be added, changed, suspended or discontinued as the platform evolves.

AI Video Studio, AI presenters and generated content

AI Video Studio may allow you to upload photographs, video, voice recordings, scripts and instructions to create an AI presenter, synthetic voice, animated avatar, edited visual or AI-generated video. AI output is generated computationally and may contain visual, audio, factual, synchronization or other errors or artifacts. SBDT does not guarantee that generated content will be perfectly realistic, accurate, uninterrupted, suitable for a particular purpose or identical between generations.

You retain whatever rights you lawfully hold in content you submit. You grant SBDT and its service providers a limited license to host, process, transform, transmit and store submitted content as reasonably necessary to provide, secure, troubleshoot and improve the requested service. You are responsible for ensuring that your uploads and instructions do not violate another person's privacy, publicity, copyright, trademark or other rights.

Consent, identity and prohibited AI uses

You may create an AI clone, presenter, voice or likeness only of yourself or a person who has independently and knowingly authorized that use. You must not use SBDT to impersonate a person, business or government entity deceptively; commit fraud; mislead others about identity or endorsement; create nonconsensual intimate or sexual content; harass, threaten or exploit another person; fabricate deceptive testimonials or reviews; interfere with elections or civic processes unlawfully; or create content that otherwise violates applicable law or another person's rights. SBDT may reject prompts, suspend access, remove content or terminate accounts when we reasonably believe the service is being abused. AI-generated disclosures or watermarks may be applied and must not be deceptively removed or concealed where disclosure is required.

AI credits, subscriptions and generation charges

AI features may use credits. The estimated credit cost is displayed before generation when available. Credits may vary based on video duration, requested processing, avatar redesign or other computational features. Credits have no cash value, are not transferable unless expressly stated, and are subject to the plan or credit-pack terms shown at purchase. Failed generations may qualify for an automatic credit return under the platform rules then in effect. Subscription credits, purchased credits and promotional or trial credits may have different expiration, renewal or usage rules as disclosed in the applicable plan. Changing or canceling a subscription does not create a right to a cash refund except where required by law or expressly stated by SBDT.

Business formation and filing assistance

SBDT may assist with preparing or submitting business filings based on information you provide. Government filing fees and processing times are controlled by the applicable agency and may change. SBDT is not a government agency, law firm or accounting firm and does not provide legal, tax or accounting advice. You are responsible for reviewing submitted information for accuracy and for ongoing compliance obligations applicable to your business.

EIN assistance

EIN assistance is optional and separate from the IRS’s own EIN issuance. The IRS does not charge a fee to issue an EIN. SBDT may charge a disclosed service fee for preparation and assistance. The responsible party must be the appropriate person under applicable IRS requirements. Additional authorization may be required before SBDT can act on a customer’s behalf. An EIN is issued by the IRS, not SBDT, and issuance or timing is not guaranteed.

D-U-N-S and business credit

SBDT does not issue D-U-N-S Numbers and is not Dun & Bradstreet or a credit bureau. D-U-N-S® is a registered trademark of Dun & Bradstreet. D&B controls its registration, profile and credit-reporting services. SBDT does not guarantee that use of our resources will establish a particular business credit score or result in financing.

Funding and grant information

Funding Finder, Grant Finder and related resources are educational discovery tools. SBDT is not a lender, broker, credit bureau or grant-making agency unless a specific service expressly states otherwise. Rates, fees, eligibility, guarantees, deadlines and provider requirements may change. Inclusion of a provider or opportunity is not an endorsement or guarantee of approval, funding or an award. Verify current terms with the official provider before applying.

Third-party services and links

The site may link to government agencies, financial institutions, Dun & Bradstreet, domain providers and other independent services. Those services are controlled by their respective owners and are subject to their own terms and privacy policies. SBDT is not responsible for third-party websites or decisions.

Orders, prices and payments

Prices shown at checkout apply to the selected SBDT service. Government fees, third-party charges, shipping or optional services may be separately identified. You authorize SBDT and its payment processor to charge the amount presented at checkout. We may reject or cancel an order when required to address an error, suspected fraud, legal restriction or inability to provide the requested service.

Customer responsibilities

You agree to provide accurate, complete and authorized information; not impersonate another person; not submit information you are not authorized to use; and not misuse, disrupt, probe or attempt unauthorized access to the site, accounts, systems or data.

Intellectual property

SBDT site content, branding and original software are protected by applicable intellectual-property laws. Third-party names, logos and trademarks remain the property of their respective owners. Nothing on this site transfers ownership of a third party’s trademark to SBDT.

No guarantees

Except for obligations expressly stated in a purchased service, tools and informational resources are provided on an “as available” basis. SBDT does not guarantee government approval, processing time, credit results, financing, grants, sales, website traffic or other business outcomes.

Limitation and applicable law

To the extent permitted by applicable law, SBDT is not responsible for indirect, incidental, special or consequential losses arising from use of informational tools, third-party services or events outside SBDT’s reasonable control. Rights that cannot legally be waived remain unaffected. These Terms are governed by applicable law, including any mandatory consumer protections that apply to you.

Changes

We may update these Terms as services or requirements change. The effective date above identifies the current version.
